Making him leave wasn't really going to happen as long as Kevin was standing there beneath the tree; Draco had nowhere to go, unless he was expected to jump between branches like some kind of monkey. He wasn't yet pushed that far, and though he smelled smoke soon after the leaf caught flame, he still didn't move too far from it.
